Chapter I - SHORT TITLE, COMMENCMENT AND DEFINITIONS

Short title and commencement.

1.  (1) These   Rules  may be  called  the  Provincial Assembly of Balochistan Rules of Procedure and Conduct of Business, 1974.

       (2)  They shall come into force at once.

Definitions.

2.    (1) In these Rules unless the context otherwise requires.-

(a)     "Act" means a Bill passed by the Assembly and assented to by the Governor;

 

(b)     "Advocate General" means the Advocate General appointed under Article 140 of the Constitution;

(c)     "Amendment" means a motion to amend an earlier motion before that earlier motion is put to the Assembly for its decision;

(d)     "Assembly" means the Provincial Assembly of Balochistan;

(e)     "Auditor-General" means the Auditor General of Pakistan appointed under Article 168 of the Constitution;

(f)      "Bill" means a motion for making a law;

(g)     "Budget" means a statement of the estimated receipts and expenditure of the Provincial Government in respect of a financial year;

(h)     "Chamber" means the place where the Assembly meets to transact its business;

(i)      "Chief Minister" means the Chief Minister elected under Article 130 of the Constitution;

(j)      "Committee" means a Committee constituted under these rules;

(k)     "Constitution" means the Constitution of the Islamic Republic of Pakistan;

(l)      "Finance Minister" means a Provincial Minster to whom the business of finance has been allotted or if owing to absence or any other reason such Minister is unable to act, then any other Provincial Minister authorized by the Chief Minister to perform the duties of the Finance Minister;

(m)   "Gazette" means the Balochistan Gazette;

(n)    Government" means the Government of Balochistan;        

(o)     "Governor" means the Governor of Balochistan;

(p)     "House" means the Assembly;

(q)     "Law Minister" means a Provincial Minister to whom the business of Law and Parliamentary affairs has been allotted;

(r)     "Leader of the House" means the Chief Minister or a member designated by the Chief Minister to represent Government and regulate Government business in the Assembly;

(s)     "Leader of the Opposition" means a member declared as Leader of the Opposition under Rule 19-C;

(t)     "Lobby" means the rooms and covered corridors immediately adjoining the Chamber and designated as Division Lobbies;

(u)     “Media” means print, electronic and social media;

(v)     "Member" means a Member of the Assembly;

(w)    "Member-elect" means a person elected as Member and notified as such by the Election Commission of Pakistan, but has not as yet made oath as stipulated in Rule 5;

(x)     "Member-in-charge" means, in the case of a Government Bill, any Minister acting on behalf of the Provincial Government, and in the case of a private Member's Bill, the Member who has introduced it or any other Member authorized by him, in writing, to assume the charge of the Bill in his absence;

(y)     "Minister" means a Provincial Minister appointed under Article 132 of the Constitution;

(z)       "Motion" means a proposal made by a Member relating to any matter which may be discussed by the Assembly;

(aa)    "Mover" means a Member who moves a Bill, a Resolution and Motion or amendments therein;

(bb)    "Opposition" means a member or a group of members, opposing the Government;

(cc)    "Orders of the Day" means the list of business to be brought before the Assembly for consideration and decision at its sitting on any day;

(dd)    "Parliamentary Secretary" means a Member appointed as such by the Chief Minister;

(ee)    "Parliamentary Year" means a year starting from the date when first sitting of Assembly is held after a General Election;

(ff)      "Precincts of the Assembly" Includes the Chamber, the Lobbies, the galleries and such other places as the Speaker may, from time to time, specify;

(gg)    "Presiding Officer" means in relation to a sitting, any person who is presiding over that sitting;

(hh)   "Private Member" means a Member who is not a Minister a Parliamentary Secretary;

(ii)      "Private Member’s Bill" means a Bill of a Member who is not a Minister or a Parliamentary Secretary;

(jj)      "Resolution" means a motion for the purpose of discussing and expressing an opinion on a matter of general public interest and includes a resolution specified in the Constitution;

(kk)    "Rules" means the Provincial Assembly of Balochistan, Rules of Procedure and Conduct of Business, 1974;

(ll)      "Schedule" means a Schedule appended to these rules;

(mm) "Secretary" means the Secretary of the Assembly and includes any person for the time being performing the duties of the Secretary;

(nn)   "Select Committee" means a Committee of a legislative body that is formed to examine and report on specific bill;

(oo)    "Session" means the period commencing on the day of the first meeting of the Assembly after having been summoned and ending on the day the Assembly is prorogued or dissolved;

(pp)    "Sitting" means the meeting of the Assembly or any of its Committees from the commencement of its business to the termination of the business for the day;

(qq)    "Speaker" means the Speaker of the Assembly and includes any person for the time being acting as Speaker under the Constitution;

(rr)     "Special Committee" means a committee formed with such composition and functions to examine and report on any issue as may be specified by a motion;

(ss)     "Standing Committee" means a committee elected by the House to deal with legislation and issues relating to departments (s) assigned to it;

(tt)     "Starred question" means a question for an oral answer;

(uu)    “un-starred question” means a question for written answer;

(vv)    "Supplementary Budget" means a consolidated statement, to be known as the Supplementary Budget Statement, laid before the Assembly under Article 124 of the Constitution; and

(ww)  "Table" means the table of the House.

           (2) Words and expressions used but not defined in these rules and defined in the Constitution shall, unless the context otherwise requires, have the meanings assigned to them in the Constitution.
